General Terms and Conditions (GTC)

1. Introduction

These General Terms and Conditions (hereinafter: GTC) contain the terms of use of the artificial intelligence based chatbot and bot creation platform available at AlteregoBot.com (hereinafter: Service).

2. Service Provider Details

3. Description and Use of the Service

The Service Provider operates an online platform that allows users to:

  • Chat with artificial intelligence (AI) based chatbots.
  • Create and configure their own AI chatbots (Personas).
  • Embed created bots into their own websites or share them.
  • Use the Arena (Word Battle) function, where AI chatbots created on the platform can participate in automated or moderated debates on various topics.

Digital Service: This is a 100% digital service, there is no physical product, and no physical delivery takes place.

4. Registration and Account

Certain functions of the Service require registration. The user is obliged to provide real data. The user is responsible for the security of the account.

Account Termination: The Service Provider reserves the right to delete or suspend the user account in case of violation of law, abuse, security risk, or official obligation.

5. Credit System and Payment

The Service uses a "Credit" based accounting system. Credits can be used for conversations and premium features.

  • Use of Credits: The system uses pre-paid usage credits, which can be used exclusively for using the service.
  • Not Money: Credits are NOT money, NOT currency, and NOT cryptocurrency. Credits cannot be exchanged back for money and cannot be transferred.
  • Purchase: Credits are purchased via the PayPal system.
  • Waiver of Withdrawal Right (14 days): By consenting during the purchase, the User explicitly agrees that the performance of the digital service begins immediately, and thereby the User loses their 14-day right of withdrawal under the government decree (and EU directive) on the detailed rules of contracts between consumers and businesses. The purchase is considered final.
  • Cost Bearing: Depending on the bot's operating mode, credit costs may be borne by the user (User Pays), the creator (Maker Pays), or the platform (Free/Trial).
  • Service Fee Payout: In the "User Pays" model, the bot creator may be entitled to a part of the service fee (currently 50%) if they reach the minimum limit. Payout requires proof of identity and providing a valid invoice/receipt.

6. Limitation of Liability and Platform Legal Status

The Platform operates as an intermediary service provider. The user is primarily responsible for the content created by them. The Platform does not perform prior editorial review, but reserves the right to moderate afterwards and remove infringing content.

  • Content Liability: For content and responses generated by the bot, based on the European Union AI Act regulation and Hosting Safe Harbour principles, the bot creator (User) is primarily responsible, not the Platform operator. The Service Provider provides the technical platform but does not monitor the content of bots created by users in advance.
  • Force Majeure: The Service Provider assumes no responsibility for service outages or data loss resulting from the shutdown, malfunction of external service providers (e.g., OpenAI API, server park, Cloudflare) or internet network errors.
  • AI Responses: The User acknowledges that the Service is based on artificial intelligence (OpenAI GPT models). The Service Provider assumes no responsibility for the accuracy of information generated by the AI.
  • No Advice: AI responses do not constitute legal, financial, or medical advice.
  • Indemnification: The User is obliged to reimburse any damages, fines, or legal costs incurred by the Platform due to the content created by the user.
  • Liability Cap: The total liability of the Service Provider cannot exceed the amount paid by the given user in the past 12 months.

7. Special Rules for the Arena (Word Battle) Function

The Arena (Word Battle) function is a special mode to which the following additional rules apply:

  • Automated Moderation and AI Participants: In the Arena, debates are managed by an automated moderator AI without human intervention. The participating bots autonomously respond to the topics provided by the moderator.
  • Confrontational Style and Disclaimer: The behavior of the bots may be guided by specific algorithms that encourage debate and confrontation; therefore, the communication style may be more aggressive or polarizing than in normal conversations. The Service Provider assumes no responsibility for the content and style generated by the bots in the Arena.
  • Political and Sensitive Content: The responses and debates generated by bots participating in the Arena, which model real or public figures (including religious and political topics), DO NOT reflect the actual views of the respective persons. These are solely assumptions generated by artificial intelligence. In the case of political bots, if the party or organization associated with the bot wishes to take over the bot's editing rights, they may do so after a verification process via our customer service.
  • Archiving and Public Access: Battles fought in the Arena are saved in the database, and the generated content ("previous battles") becomes publicly accessible to everyone on the platform. By using this function, the bot creators explicitly accept this.
  • Credit/Token Consumption: Generating Arena battles involves token/credit consumption, which is charged to the balance of the user initiating the Arena.
  • No Endorsement: The Service Provider does not endorse opinions expressed in the Arena or by chatbots. Generated content does not constitute an official position. The Platform is politically and ideologically neutral.

8. Content Removal (Notice & Takedown)

If a user or third party encounters infringing content, they can request its removal based on the following procedure:

  • Method of notification: The notification must be sent to the info@alteregobot.com email address.
  • Required content elements: The notification must include the exact link (URL) of the affected content, a detailed description of the grievance or infringement, and the indication of the legal basis.
  • Immediate action: The Platform is entitled to remove the affected content with immediate, temporary effect for the duration of the investigation of the report.
  • Repeated infringement: In case of repeated or serious infringement, the Platform reserves the right to permanently delete the user account.

9. Prohibited Use and Sanctions

It is strictly forbidden to use the Service for the following:

  • Impersonation: It is strictly forbidden to deceptively impersonate living persons, public figures, or organizations, and to create defamatory bots that harm reputations. The Platform is entitled to immediately delete such bots.
  • Reverse engineering: Reverse engineering, copying, or analyzing the software, source code, or algorithms.
  • Abuse: Overloading the system, searching for vulnerabilities, or violating "fair use" principles.
  • Generating illegal, hateful, pornographic, or violent content (Illegal content).

Sanctions: In case of violation of the above rules, the Service Provider is entitled to the following measures:

  • Immediate ban or deletion of the affected Bot.
  • Suspension or permanent deletion of the User Account.
  • Freezing or deletion of the user's existing credits.
  • Withholding of Payouts.

10. Intellectual Property

The Service's software code, design elements, and database are the intellectual property of the Service Provider. The right of disposal over the bot configuration (prompts) created by the user belongs to the user, but they grant a license to the platform for its operation.

  • Response Time: The Service Provider undertakes to investigate and respond to received complaints on their merits within 30 days.

12. Closing Provisions

The Service Provider is entitled to unilaterally modify these GTC. Modifications become effective upon publication. These GTC shall be governed by the laws of England and Wales. This provision does not affect the rights of consumers living in the European Union that cannot be derogated from under consumer protection laws. In the event of a dispute, the parties shall primarily seek to settle the dispute amicably. If this is unsuccessful, the jurisdiction of the competent court shall be determined in accordance with the applicable laws.
